Justice Barrett recused herself from the case appealing the decision of the Oklahoma Supreme Court.
The Supreme Court, in a split decision with Justice Amy Coney Barrett recusing herself, upheld the ruling previously made by Oklahoma’s Supreme Court by default to bar the authorization of a Catholic school from being a charter school. The state court had blocked the Catholic church from forming its charter school because the laws of its state mandate that charter schools remain non-religious.
The U.S. Supreme Court’s decision by default allows the high court to hear similar cases from other states.
The Supreme Court released a brief opinion along with its ruling, stating, “The judgment is affirmed by an equally divided Court. JUSTICE BARRETT took no part in the consideration or decision of these cases.”
